Private facilities

NSW Health is the regulatory authority for privately owned and operated hospitals and day procedure centres across the state. The Private Health Care Branch has responsibility on behalf of the Director General for regulating private health care facilities and enforcing licensing standards under the:




The legislation exists to ensure that health services provided to the community by the private health sector are safe, appropriate and effective. The Private Hospitals and Day Procedure Centres Act 1988 and associated Regulations set out the requirements for licensing and the minimum standards of care and safety for admitted patients.

The Private Health Facilities Act 2007 was passed by the NSW Parliament on 6 June 2007 and received assent from the Governor on 15 June 2007. None of the provisions of the Act have commenced and the existing Private Hospitals and Day Procedure Centres Act 1988 remains in force.

The new Act will not commence until after regulations are drafted and approved by the Governor. There will be consultation with stakeholders and time for public comment regarding the new regulations.
